1. Definitions

• "Amberkith", "We", "Us", "Our" — refers to the business operating under the name Amberkith, based in George Town, Penang, Malaysia.
• "Session" — any of our educational facilitation offerings: the Listening & Speaking Workshop, the Family Records & Planning Session, or the Family Continuity Programme.
• "User", "You" — any person who visits our website or makes an enquiry or booking.
• "Website" — the site accessible at https://amberki.cyou.
• "Agreement" — these Terms and Conditions together with any session booking confirmation.

2. Acceptance of Terms

By accessing our website or submitting an enquiry form, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into these terms, and that you accept them in full. If you are booking on behalf of a family group, you confirm that you have authority to do so.

3. Description of Services

Amberkith provides educational facilitation and document organisation sessions for families. Our sessions are non-advisory in character. We do not provide legal, financial, counselling, medical, or any other regulated professional advice. Our facilitators are not solicitors, financial advisers, registered counsellors, or medical practitioners.

Where enquiries or session content touch on matters that require professional advice, we will direct you to the appropriate professionals or official bodies. Our sessions are available in George Town, Penang. Availability is subject to scheduling and may vary.

4. Booking and Confirmation

A booking is confirmed when we provide written confirmation by email or phone. Payment terms and session dates are agreed at the time of booking. We reserve the right to decline or cancel a booking if we determine that our sessions are not suitable for the enquiry.

5. Payment Terms

• All fees are quoted and payable in Malaysian Ringgit (RM).
• Session fees: RM 520 (Listening & Speaking Workshop), RM 1,850 (Family Records & Planning Session), RM 4,500 (Family Continuity Programme).
• Payment is due in full before or on the day of the session unless otherwise agreed in writing.
• Accepted payment methods will be confirmed at the time of booking.

6. Cancellation and Rescheduling

• Cancellations made at least 48 hours before the scheduled session will not incur a fee; any advance payment will be refunded or applied to a future booking.
• Cancellations made within 48 hours of the session may result in a cancellation charge of up to 50% of the session fee.
• We reserve the right to reschedule a session in exceptional circumstances. In such cases, we will offer an alternative date or a full refund.
• Refunds, where applicable, will be processed within 14 working days.

7. User Responsibilities

You agree to:

• Provide accurate information when enquiring or booking.
• Attend sessions with a genuine intention to engage with the educational content.
• Not use our sessions for any unlawful purpose.
• Treat our facilitators and other family members present with respect.
• Understand and accept that our sessions do not substitute for professional legal, financial, or counselling advice.

8. Intellectual Property

All materials provided during sessions — including guides, checklists, templates, and binders — are provided for your personal family use only. They may not be reproduced, distributed, or used for commercial purposes without our prior written consent. The content of our website and materials remains the intellectual property of Amberkith.

9. Disclaimers

Our sessions are educational in nature. We make no representation that attending a session will produce any particular outcome — in your family relationships, in your document organisation, or in any interaction with professionals or government bodies. Session materials are provided as general educational resources and not as advice specific to your legal, financial, or personal circumstances.

Our website is provided on an "as available" basis. We do not warrant that it will be uninterrupted or free from errors.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Amberkith shall not be liable for any indirect, incidental, or consequential loss arising from your use of our website or sessions. Our total liability for any claim arising from a session shall not exceed the fee paid for that specific session.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

11. Confidentiality

Information shared during sessions is treated with care and is not disclosed to third parties except as described in our Privacy Policy or where required by law. Please refer to our Privacy Policy for full details.

12. Termination

Either party may cancel a booking in accordance with Section 6. We reserve the right to end a session early if a participant's conduct is disrespectful or if the session content moves into territory outside our educational scope and cannot be redirected. In such cases, no refund will be provided for time already spent.

13. Dispute Resolution

If a dispute arises from these terms or a session, we ask that you contact us first at [email protected] so we can attempt to resolve the matter informally. If informal resolution is not possible, these terms are governed by the laws of Malaysia, and any dispute shall be subject to the jurisdiction of the courts of Penang, Malaysia.

14. General Provisions

• Entire agreement: these terms, together with any booking confirmation, form the entire agreement between us for each session.
• Severability: if any provision is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: you may not assign your booking to a third party without our prior written consent.

15. Changes to These Terms

We may update these terms from time to time. The current version will always be available on our website with a "Last Updated" date. Continued use of our site or services after changes constitutes acceptance of the revised terms.
